Oracle has added contractual protection around one of the most ambitious AI infrastructure projects in the US, underscoring how construction risk is becoming a core part of the AI capital story.

What happened

Oracle sent a force-majeure notice to the developer of Project Jupiter, the New Mexico Stargate data-centre campus intended to provide compute capacity for OpenAI. The notice does not mean Oracle is leaving the project. Instead, it could allow Oracle to delay certain payments if the campus misses its targeted 2028 start date. Oracle has said it does not currently expect a delay.

The move matters because projects at this scale combine huge power requirements, long construction timelines and substantial financing commitments.

Why it matters

AI infrastructure is increasingly starting to resemble energy and industrial-project finance rather than conventional software spending. Delays in land, grid connections, construction or equipment can create material financial exposure for every party involved.

Contractual mechanisms such as force majeure therefore become strategically important, especially when infrastructure is being built years ahead of expected demand.

The AI race is no longer only about models and chips. It is also about whether developers can deliver power, data-centre capacity and financing on schedule. As projects get larger, execution risk will become a bigger part of how investors judge the sector.
